FITNESS & HEALTH WAIVER

1. MEDICAL DISCLAIMER

FitKit is a fitness management platform that provides tools for scheduling, workout tracking, and programming delivery. FitKit does not provide medical advice, diagnosis, or treatment. Nothing contained in this platform, or in any content delivered through it, constitutes medical advice.

Before beginning any exercise program, you should consult a qualified physician or other licensed healthcare provider, particularly if you have or suspect you may have any of the following: heart disease, high blood pressure, diabetes, joint or bone problems, pregnancy, respiratory conditions, or any other health condition that may be affected by physical activity.

2. ASSUMPTION OF RISK

Physical exercise involves inherent risks, including but not limited to: muscle strains and sprains, joint injuries, cardiovascular events, falls, and other accidental injuries. By using this platform and participating in any exercise programs, classes, or activities organized through it, you acknowledge and voluntarily assume these risks.

You represent that you are physically capable of participating in the activities you choose, or that you have obtained clearance from a licensed healthcare provider to do so.

3. RELEASE OF LIABILITY

To the fullest extent permitted by applicable law, you hereby release, waive, and discharge FitKit, its officers, directors, employees, agents, and affiliates (collectively, "Released Parties") from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury — including death — that may be sustained by you as a result of participating in any exercise program, workout, class, or activity organized or delivered through the FitKit platform.

This release applies to injuries caused by the negligence of the Released Parties, except where such negligence constitutes gross negligence or willful misconduct under applicable law.

4. INDEPENDENT TRAINER AND GYM OPERATORS

FitKit provides software tools to fitness businesses and trainers ("Operators"). Operators are independent entities and are not employees or agents of FitKit. FitKit is not responsible for the quality, safety, or content of any workouts, programming, or coaching instructions provided by Operators.

Any claims relating to exercise instruction, programming quality, or physical training you receive through an Operator's use of FitKit should be directed to that Operator.

5. MEDICAL CERTIFICATE REQUIREMENT

Some fitness organizations using the FitKit platform may require you to provide a valid medical certificate before participating in classes or programs. If your organization requires a medical certificate, it is your responsibility to obtain and submit one. FitKit does not verify, store, or process medical certificates directly — this is managed by your organization.

6. MINORS

If you are under 18 years of age, you must have your parent or legal guardian read this waiver and provide their consent on your behalf before you use the platform or participate in any activities organized through it. By proceeding, the parent or guardian confirms they have reviewed and accepted this waiver on behalf of the minor.

7. GOVERNING LAW

This Fitness & Health Waiver is governed by the laws of the State of Israel. Any disputes arising out of or related to this Waiver shall be subject to the exclusive jurisdiction of the courts of Netanya, Israel.
