ACCEPTABLE USE POLICY

1. PURPOSE
This Acceptable Use Policy ("AUP") governs your use of the FitKit platform and services (collectively, the "Services"). By accessing or using the Services, you agree to comply with this AUP in addition to our Terms of Use and Privacy Policy.
2. PROHIBITED USES
You may not use the Services to:
- Violate any applicable local, national, or international law or regulation.
- Transmit any material that is unlawful, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable.
- Infringe the intellectual property rights or privacy rights of any third party.
- Impersonate any person or entity, or falsely represent your affiliation with any person or entity.
- Collect or harvest personal data about other users without their explicit consent.
- Distribute unsolicited commercial messages (spam) to other users of the platform.
- Upload or distribute malware, viruses, or any other malicious code.
- Attempt to gain unauthorized access to any portion of the Services, or any other systems or networks connected to the Services.
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Services.
- Use automated tools (bots, scrapers, crawlers, or similar) to access, extract, or index the Services without our prior written consent.
- Interfere with or disrupt the integrity or performance of the Services or the data contained therein.
- Resell, sublicense, or commercially exploit the Services without FitKit's prior written permission.
3. CONTENT STANDARDS
Any content you create, upload, or share through the Services (including workout names, community posts, announcements, and member communications) must:
- Be accurate and not misleading.
- Comply with all applicable laws and regulations.
- Not contain discriminatory language based on race, ethnicity, religion, gender, sexual orientation, disability, or national origin.
- Not promote dangerous, illegal, or harmful activities.
- Not include personal health or medical advice that requires professional licensing.
4. ACCOUNT USAGE
Your account is personal and non-transferable. You may not share your login credentials with other individuals or allow others to access the Services using your account. If you are an organization account holder, you are responsible for all activities conducted through your organization's workspace.
You must promptly notify FitKit at support@fitkit.fit of any unauthorized access to your account.
5. API AND INTEGRATION USE
Access to any FitKit API is subject to separate API terms and rate limits. You may not use the API in ways that place excessive load on our infrastructure, circumvent access controls, or aggregate data for purposes not permitted under these terms.
6. ENFORCEMENT
FitKit reserves the right to investigate suspected violations of this AUP and to take any action it deems appropriate, including removal of content, suspension, or termination of access, without prior notice. We may also cooperate with legal authorities where required.
Violations of this AUP may also constitute violations of our Terms of Use and may result in civil or criminal liability.
7. REPORTING VIOLATIONS
If you become aware of a violation of this AUP, please report it to us at support@fitkit.fit.
8. GOVERNING LAW
This Acceptable Use Policy is governed by the laws of the State of Israel. Any disputes arising out of or related to this Policy shall be subject to the exclusive jurisdiction of the courts of Netanya, Israel.
